Definitions used in this document
- WebsiteBuilders - the company supplying the website, design, hosting or related service
- The client - you
- Website - the Client's website, the result of the service we provide.
- Downtime - periods of unavailability of website caused by any factor.
Ownership and intellectual property
Any elements of text, graphics, photos, contents, trademarks, or other artwork furnished to WebsiteBuilders by the client for inclusion in the website remain owned by client.
WebsiteBuilders assumes the client owns, or has permission from the rightful owner to use, any images or design elements that are provided by the client to WebsiteBuilders for inclusion in the website, and that the client will hold harmless, protect, and defend WebsiteBuilders from any claim or suit arising from the use of such elements.
Client-specific graphical elements, logos, photographs or text created by WebsiteBuilders as part of supplying a service remain the intellectual property of WebsiteBuilders. In most circumstances permission will be granted to the client to make use of the client-specific graphical elements, logos, photographs or text created by WebsiteBuilders beyond the context of the website.
Graphical elements, symbols, icons, photographs or text that are not specific to the client and which are included by WebsiteBuilders in the design of the client's website remain the property of WebsiteBuilders and may not be used outside the context of the website being provided by Websitebuilders or sold, lent or otherwise made accessible to any third party without the express permission of WebsiteBuilders.
Any computer code, including but not limited to scripts, applications (apps), widgets, plugins, schemas or algorithms, created by WebsiteBuilders as part of supplying a service to a client remains the intellectual property of WebsiteBuilders and may not be used, given, sold, lent or otherwise made accessible to any third party without the express permission of WebsiteBuilders.
Services are provided upon the condition that they are run solely on servers provided by WebsiteBuilders. In the event a client wishes to move their website to another provider's servers, WebsiteBuilders will make the underlying code available at its discretion.
Rectification of defects
After testing and acceptance by both parties has been completed, any issues that arise are normally dealt with by WebsiteBuilders at no extra cost as part of their ongoing support, exceptions to this are where issues arise from a new requirement, extention of existing requirement, omission by client during the design and development process.
Issues arising from malicious hackers or unauthorised 3rd party activity will normally be dealt with by WebsiteBuilders as part of their ongoing support, excepting where the client has allowed unauthorised 3rd party access to the website or where 3rd party code, applications (apps), widgets, plugins are installed at the client's behest. Where a client requires the inclusion of 3rd party software, applications (apps), widgets, plugins or other elements of code not created by WebsiteBuilders or their agents, these will be included, configured, interfaced with and tested at functional level by WebsiteBuilders without warranty as to the effectiveness, security or long-term stability of the code.
3rd Party Warranty
WebsiteBuilders provides a hosted website service via its preferred 3rd party hosting suppliers. Unless otherwise agreed, all websites supplied by WebsiteBuilders are hosted on shared hosting platforms. WebsiteBuilders makes everyreasonable effort to ensure that downtime of a client's website is kept to a minimum, WebsiteBuilders can take no responsibility for the performance and availablity of its provider's shared hosting servers or connectivity to the Internet.
